I signed a contract to sell my house. The agent never returned my calls always took 5 - 10 days. They would rumage through my belongings, leave the t.v on after an open house, and gave me 10 minutes notice before an open house or showing. I told them i was uphappy and wanted out, they said for them advertiseing for the 25 days would cost me $2,500 to get out. This agent, was rude on the phone and made me uncomfortable. I would call him , and never get a call back only time i ever got a call was they forgot my house key for the open house. This was a terriable expierence and i jsut wanted out with good terms and thought they would agree. They then lowered my asking price with out my approval and the agent was rude and crude to my fiance when asking questions. I am finally out of this contract now. Is there anything i can do so this cant happen to others? I feel this agent should not be doing a job if he cant respect and have customer service even after a contract is signed.

Are you in NY? I know here we can file a report with the office of professional discipline as well as the attorney general. I suggest you make a complaint.

anything they do or say must be written in thier company policy/contract make sure of that. also make sure you document everything that has occurred. its possible they can charge some fee for services but most likely not if you didn't sign any agreement

Lodge a complaint with the OWNER of the real estate agency. There is a State Licensing Board you can report your loathsome agent to. I would talk to a real estate attorney about recovering the difference in my asking price and the price the agent set. You have one major problem, you signed the sales contract. If you had refused to sell at the lower price you would have a stronger case to sue for the difference.

Have you paid money in advance? if not, change you locks.Then go to small claims court and sue them for $1.If otherwise, decide whether you can demonstrate how they failed to meet the obligations set forth in their contract - and go to small claims court and sue them for the damages (ie: their fee).Or place a big bucket of Dog Crap in the living room floor and have an open house.Or - better yet - drop a fake diamond necklace on your front steps, and then film one of their associates or potential buyers stealing your property.Or - Make something up that got stlen at the same time they were there, file a report (don't get arrested) and that would fairly well keep all future levies, judgements, and or grievances from being judicially liened against you.Or - use your imagination.File a restraining order against them.But is you simple lodge a complaint with the Realors Governing Board of your State - and sue them in court for $1 - you will win.If you wait for them to sue you - it's just harder.Afdter all, none of thae above is any more unethical and unjust than having someone else go through your underwear drawer - Sue them, state after your realtors or their prospective clients left, your underwear drawer was in disarray and had somebody else's pubic hair in them - I think they will decline to answer the charges in court - and you win by default.

The agent needs to be reported to not only the broker but the Real Estate Commission.I would also call the local MLS and tell them to shut off the lockbox because you are not permitting any more showings of your home and the agent has refused to comply with requests.I would also send a certified letter to the agent informing them that if they enter the home again after said date, you will consider it breaking and entering.There are other ways out of a contract...what is the expiration date? Do you know that in EVERY state all listing contracts must have an expiration date and they cannot automatically renew?What you are describing is not only unprofessional, I would consider it criminal.

I would first contact the agents broker and demand a cancellation of listing agreement. If that isn't successful, I suggest you contact your states commerce department and file a complaint. I have never in my career charged a seller for advertising!

I have been investing in real estate over 40 years.I have never used a real estate agent, real estate broker or REALTOR or whatever else they choose to call themselves.They are very poorly trained and they are not competent to represent the interests of anyone. They are nothing more than salespeople.Unfortunatley the way a typical listing contract is written you are liable to pay the full commission if you cancel your listing.When the agent reduced your asking price without your permission he committed an act in violation of your agreement, and left a paper trail making it very easy to prove.A good real estate attorney will have a field day with this clown.I recommend that you hire an attorney who specializes in real estate law to talk to this character and send him a letter or two.A good attorney will put the fear of god into this idiot. He will never bother you again and hopefully he will not bother anyone else either, although that may be too much to hope for.

1. In short to your first question, legally probably not, you can't get out of a listing agreement until after it's expiration date at which time it automatically terminates unless you renew. UNLESS they somehow do not uphold their end of the listing agreement, which if they lowered the asking price without your written consent (even a verbal is unenforcable) you probably would have grounds for terminating your listing contract, but that is a question for legal council. However (in regards to your first question) you can talk to the broker of the real estate agency you chose to represent you and air your complaints and / or request a different agent be appointed to represent you. Chances are the broker will do whatever it takes to make sure you're satisfied with your experience with them. It's their business' name on the line. 2. If the agent was a REALTOR (ALWAYS use a REALTOR. Not all agents are REALTORS, it's an extremely important distinction in oversight and subscription to a specific code of ethics) complain to your local board of REALTORS. They will be brought before the ethics commitee and face fines and/or suspension or revocation of their license. Type in a search browser your state and realtor associations (Ex. Virginia realtor associations) and you should be able to follow links to the association that is for your area. Someone at the association can tell you if the agent you dealt with was a REALTOR. If you haven't already done it, complain to the agents broker, it's best if it's done both in person as well as in letter form. You can file complaints with the Better Business Bureau as well as your states Department of Professional and Occupational Regulation. Interview at least 3 REALTORS and ask for references if you choose to list your home again. There are a lot of committed, professional REALTORS out there, but as with every profession there are some bad apples. I'm truly sorry for your bad experience, best of luck to you in the future.

Getting out is easy if you know the rules.First off your listing is with the COMPANY the agent works for NOT the agent.Call the office where the agent works and ask to speak to the DESIGNATED BROKER. This is her boss and she works for them.If the boss says "Cancel the listing" then the agent has no choice but to cancel the listing.Hope this helps.Terry S.http://www. Welcome2Arizona.com
