A friend of mine wants to take his ex-partner to court to prevent her from aborting their unborn child. He was very much in love with her, she fell pregnant than changed her mind about wanting to have a child again, which has strained their relationship. His 40 years old, self made earns about $150,000 a year and has a $2 Million Real Estate portfolio. He wants to have a family of his own but could happily raise his child if need be with or without her. In his words "she's about to kill my child, she's murdering my gene pool"Does she have the "right" to kill HES gene pool ? What about hes right to protect his unborn child, to have someone to laeve it all to, a lifetimes work ? Does any women REALLY have that right ?David P; Brilliant assertion ! You can take a ham sandwich to court,Stopping her from controlling her own body might be a little more difficult.That is NOT your decision, you are out of line.

Philospohically, that woman doesn't have the moral right to do such a thing. But legally, I dont think that he has any say over her reproductive rights. SInce she is having the baby, he doesn't get to decide what happens to it, even though it is half his. It's sad really. He really should try and talk her out of this, it's disgusting.

This is a tough one. Unfortunately men have no concept of what it is to be pregnant. You cannot force someone to alter their body to your liking. I know this is a live being, a child but I seriously doubt that any judge would force her to carry a child, go through morning sickness, bloating, body changes, emotional changes, and birth/delivery so she won't "kill his gene pool". Sorry

I believe that a woman has this choice with her body. That is so sad that your friend wants his baby and she would do that to her child! Tell your friend to keep trying to talk with this woman and not to give up trying to save his childs life. Tell him not to threaten her with court or anything or she will just avoid him. He needs to tell her how much he still loves and wants them both in his life. Whatever went wrong he needs to try to fix it! Tell him to do whatever it takes to make her change her mind sweetie. good luck.

It's her body and she has to live with the physical and mental results of having a child wether she raises the child or not. If the pregnancy was planned I would say he could have a sliver of a chance at a court case, but since it was not planned and they aren't married, I doubt he stands a chance in hell.If he wanted children so darn bad then he should have found a partner who also wanted to have children.you also stated that she was no longer with him so he really doesn't have a say in her life....he was simply a sperm donor. And she didn't want the donation.

He can not legally stop her from aborting so he needs to talk, beg, and plead with her to carry the child to term. Ask her what she would require to carry the child to term and then make it happen. G'luck!

A wife's right to choose abortion takes precedence over the husband-and-wife relationship. A husband may not preclude his wife from having a legal abortion, nor may he compel her to have one. The Supreme Court struck down statutory requirements that a husband must be notified of his wife's abortion, in Planned Parenthood v. Casey, 505 U.S. 833, 112 S. Ct. 2791, 120 L. Ed. 2d 674 (1992).

Of course the woman has that right. It's her body. If he's so worried about his gene pool, he should get a surrogate mother to carry the baby for him, at least if she changes her mind, he can sue her for breach of contract. LOLNo, seriously, the minute he stuck it in, he lost all say-so over the consequences. Besides, you say that these two are no longer even together. Is this your friend's pathetic attempt to control his ex even beyond the duration of their relationship?

Eventually this is going to happen. The support for Roe v. Wade is slipping. There was a report done last year or the year before that showed the 51% of women now oppose abortion. This report received little attention because it was conducted by a pro-choice advocacy group, and they were a bit shocked by the results.The feminist movement is also losing momentum, and more and more people are recognizing that the rights of the family take precedence over the rights of the individual, whether it be the man or the woman.So eventually you are going to get a court that will recognize that the rights of the father and the rights of the unborn child out weigh the rights of the mother. This will of course be challenged and appealed and will work it's way up all of the way to the supreme court. I have no idea what the outcome will be but I suspect that eventually there will be a ruling to the effect that the woman's right to choose was the right to choose to have sex. Once she conceived she must take responsibility for her actions.People are going to disagree with me on grounds of personal beliefs and convictions but my opinion is based souly on the bigger social picture. Political and social morays shift and the liberal point of view reached its apex in the early to mid '90's. The pendulum has begun to swing back towards the Conservative.So yes, eventually you are going to see the courts assert the fathers rights.

Yes she does have the right to terminate the pregnancy, and he has a right to be a father too. What he needs is a really good mouth peice and take it to court. The court will look at the circumstances to the lead up to her decision, he's not a puppet she can't toy with his emotions like that. Yes it is her body and yes she is the one that will carry the baby but it sounds to me like he would support & care for her for the sake of the child, but i hope he can resolve it before it gets that far. I wish him luck!!
