| A community has enacted a law that requires residents to separate their garbage into recyclables and non-recyclables. The recyclable items are placed in plastic containers marked “Property of the City of Ecology.” The city collects the contents of the containers and sells it to a recycling facility, boosting the city budget by several hundred thousand dollars per year. Joe, a homeless man, makes the rounds on garbage day and selects metal cans from the recycling bins, which he crushes and sells to a recycling facility. He is arrested and charged with theft of city property. You have been asked to analyze the case on behalf of the Public Defender representing Joe. What is Joe’s best defense to the theft charges? |

| That is so horrible! That just makes me sick! I know he could not have made very much money doing that. Why are they wasting tax dollars on this! Recycling is for the environment! It was getting recycled and helping a poor homeless man. I don't know what his best defense would be. Maybe (this may be silly) if you could go around to all the homes that he collected from and get them to sign something saying they didn't mind him taking the cans...they rather him have them. I mean I would not think it is really city property until the city picked it up. Maybe collect a small donation from them to "pay" back the city for the cans? Like I said I am sure he did not make very much money doing that! It is so sad to me that tax money is being used to go after this man. Maybe the old man should charge the city for his services!! I am sure he walks along the road picking up "trash" (can and such that people through out of their car) Good luck! I know nothing I said will help but I just wanted to let you know how mad that made me:) |

| Mr. prosecutor, my client has demanded a trial. as he is homeless and probably will not show up in court I insist you keep him in jail, feed him make sure he sees a doctor and make sure he makes all his court appearances. My hands are tied. i must take this to trial but you have the option to dismiss. |
