| My father has a section 8 tenant living in a rental she has been there about 4 years. she is on month to month, sent her an eviction notice (however i have heard that it was not properly done) 3 1/2 months ago. she still hasn't found a place to live . she has her and 1 kid on the lease(her older son was just taken off) it seems that there are about 4 extra adults living in this home with her she only has to pay 400.00 a month sec. 8 pays 1700.00 dad pays all utilities(water bill has been extremly high lately) how can we prove legally that there are more people living in this house so that we can evict her...family needs to move into the home and we cant get her out. S.F rent control "you have to pay each person 4500. and child 3000. relocation fee(very unfair) and you must give 90 days notice and she still wont leave...i'm looking for some advice on how to evict due to more people living in the house then agreed to on the lease...advice please saw attorney already, need more help!!!!!! |

| try posting this question on the creativeinvestor website......I listed it below for you.......its free.......but they may know a lot of them are landlords and deal with these issues all the time......you can post it in their forum. Hope this helps! |

| go to "nolopress.com" and buy their "california landlord tenant laws". It's $30 and worth it's weight in gold. It not only tells you the law, even for San Francisco, it provides the forms and lays out the timelines for filing and what the requirements are.If the renter is in violation of the agreement generally the landlords word is sufficient, but you might send her a short letter telling her you are updating your records and need the names of everyone living in the house CURRENTLY. If it comes back with more names than you have on your rental contract re-serve the eviction notice and include the violation of the contract. At the end of 90 days go to court and file for eviction proceedings. They will serve the tenant with ANOTHER 30 to 90 days. At the end of that time have the sheriff's department, or whoever does civil evictions in SF, and they'll move them out. Don't notify section 8 housing until they're evicted, unless you're required to, otherwise they may quit paying and you're out the $1700 a month.www.nolopress.com |

| Personally I would call the housing authority and declare welfare fraud. They will drop by and check it out.Hire yourself an eviction service. It costs about 600 and will make sure everything is done correctly. If you evict for cause (sub-leasing) you do NOT have to pay any relocation fee. That is for when you evict in order to remodel or sell. |
