| its a question on a worksheet for class, but i just cant figure it out, can someone help and explain it to me...a liscensed real estyate broker who engages the services of a liscensed sales person on the basis that the broker can direct what the salesperson can do but not how it is done has:A. engaged an independent contractorB. discriminated illegallyC. practiced steeringD. established an employer- employee relationship |

| B & C are clearly incorrect. Licensed Real Estate Sales persons are almost always Independent Contractors. The licensed Salesperson must work under the supervision of a Licensed Broker, so the Broker can direct how work is done (to ensure it complies with all laws and regulations). However, if the Broker directs what work is done, the Broker has established an employer-employee relationship. So the correct answer is "D". |
