i found, leased, and made all of the deposits on an apartment. i later had a room mate move in and added to the lease. i would like him to leave.... do i have more rights then he does? what can i leagaly do to get him OUT!????

If he signed a lease and is not doing anything wrong he don't have to go anywhere. If he is doing stuff he shouldn't, and you leagally made a lease with him, then you will have to evict him. It has to be leagel.

well if it is leased in your name you can legally kick him out. but you have to give him a certain amount of time notice, before u take the keys off him and lock him out. and mkae sure u give him till the end of the month or week depending on ur payment dates. good luck!

You have no right to get him out since you had him sign the lease. You will both have to come to an agreement whether to live out the lease term or one of you move out and sign off the lease. It has to be a decision mutually agreed to by all parties as all parties must sign the changed lease terms.

make scary noises at night and bangings on the wall, if he approaches you about it say you never heard anything and you were asleep. Then hire a neighbor to tell a made up story that the house is haunted.nevermind thats too much work...just tell him you need him to move out and tell him why. no better way than honesty.

You said you had him "added to the lease", this makes me believe you had your landlord add him as a tenant and he was approved with him/her. If that is the case, "you" cannot do anything, your landlord needs to evict him. Is he doing something that vioates the lease? If you have a sublease with him, then you are his landlord and you can evict him on 30 days notice, but that can get very touchy especially if your lease does not have a provision for subletting.

If his name is on the same lease you are on, he has the same rights as you do to the apartment. You would have to have him agree to relinquish his name off the lease, but that is something you both have to agree on. If he won't do that, maybe you can relinquish your name off of the lease and move out, but again, he would have to agree to it. Otherwise, the landlord is the only one that can evict him.

A lease is a legal agreement. In this case it was between the owner and YOU. Then you added your roommate, so now it's between the owner and YOU and your ROOMMATE. The only way I know of to "add" a roommate is to draw up a new lease, canceling the first one. You have no special standing because you were "first," because you weren't. "Adding" him created a new agreement. Unless he is breaking the lease (non-payment or non-performance of lease,) the owner can't evict him. It's difficult for the landlord to evict ONE tenant- usually they ALL go. Evictions usually read "JOE BLOW- and any other tenant." That's not to say it can't be done- I've done it.I'm afraid you will need the advice of an attorney on this one. Good luck.
