I have a question about a child supportcase.I just wonder why I filed child support withthe dept of human services and nowit is with a prosecuting attorney office.What does this mean?That he won't pay.We already filed out financial formsand did paternity tests.I thought in order for this to got to an attorney I would have to file with them myself.I am just not too familar how this legal system works with child support.

the reason why is the state wants to collect the money for you and its pretty normal when this happens i had it happen to me when my ex took my daughter to another state and filed for support through them

The prosecuting attorney works for the State agency where you applied for child support.The State is pursuing your child support without any charge to you.You could have retained your own attorney for this matter, but you would have had to pay the attorney fee yourself.

Dept of Human Services? As in welfare? If you are applying for state aid of any sort, they are going to try and increase your income by ensuring he pays his child support. They may have assumed he isn't paying because you applied for aid. But it sounds as if you never even got a support order, so he hasn't been obligated to pay. It may just be at the attorneys office to set up his payments as a payroll deduction (which is becoming more and more normal).Start by talking to your caseworker and asking what all that means. And you really need to educate yourself on child support and what your rights and his obligations are.
