I am currently in a situation where my HOA is suing the contractor that upgraded my condos. I am needing to either sell or refi or I will be forced to forclose. Ive tried to refinance but lendors will not accept me due to that major factor. Can I put in a civil suit to the contractor or other type of suit I can do so If i do loose my home or so that it doesnt affect my credit or loose out on the fees for forclosure ( attorney fees, late fees, capital gains taxes ). Any one have any suggestions or ideas?

I have done refi's on condos when the HOA is in active litigation, it's difficult, but if you have enough lenders at your disposal it can be done. What lenders have you tried? Have you tried going through a broker? There are lenders that don't ask for an HOA questionaire. Contact me if you need more info.
