| Hi,A few years ago I was asked to resign from my position. To get my severence, I signed a document that said I wouldn't talk bad about the company or the people I worked with. Over the last couple years I have become frustrated with what happened. I have started blogging what happened, changing the names of the people and the place I worked. My question is, can I get in trouble for blogging not using my name? |

| That's dicey. Usually, what you sign is a 'non-compete' clause or agreement. This is specifically related to company and industry information, but depending on how it is worded, may include looser terminology. Also, check your copy (you kept a copy, right?) to see if there is a time duration. There usually is. If you did not keep a copy, maybe you can ask to see your employee file. If there is any static, find a lawyer.Slander turns to libel when it is in written form. This is a prosecutable offense, but you really have to cross some lines to lose in court. Still, it could cost you time and money fighting it if it came down to it. Changing all names, not referring to departments or positions exactly as the company did, and only generalizing as to what industry you were in will help avoid libel.Good luck. Hope you vent it all soon. Anger is not a healthy controlling emotion. |

If you are doing this, you need to be aware that people have been tracked down and sued by individuals and corporations.Avoid saying anything that will identify the organisation in any way. Making up a 'sound alike' name is probably not enough if you don't take any other steps to disguise their identity. And ensure whatever you write is absolutely true, because that may be a defence if they do catch up with you. Finally, if you intend to continue along this path, you may wish to consult a solicitor / lawyer or a community law organisation to find out just what your rights are.It may be that there is some sort of limitation on the document you signed, maybe the document is not binding, or it may be that you are playing with fire!I'm thinking the firm is still around if you are blogging about this now, so caution is warranted. While it's true that you could rseearch this yourself, the area of corporate law and is extensive and tricky, and a legally trained person can ensure you are on the right track as well as save you a LOT of time!Cheers |

| My advice is to forget what happened and move forward...its not worth any trouble; you should be focused on your future and bury the past!! |
